These Terms of Use ("Terms") govern your access to and use of the DigiGo platform, including our website, mobile application, APIs, and related services (collectively, the "Services") operated by DigiGo LLP ("DigiGo," "we," "us," or "our").
By accessing, registering for, or using the Services in any way, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services.
1. Eligibility
You represent and warrant that:
- You are at least 18 years old and have full legal capacity to enter into these Terms.
- You agree to use the Services in compliance with all applicable laws and regulations.
2. Accounts & Registration
To access certain features of our Services, you must create an account.
- You agree to provide accurate, complete, and up-to-date information during registration and to update it as necessary.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You must immediately notify DigiGo of any unauthorized use of your account.
3. Scope of Services
DigiGo provides digital identity verification and hotel check-in related services that enable guests to share verified identity information with hotel partners to streamline check-in processes. Your identity data may include government-issued IDs (e.g., Aadhaar, Driving License) and related verification information.
You understand and agree that:
- DigiGo facilitates identity verification, but does not issue identity documents or act as a government authority.
- Your ability to use the Services may depend on third parties, including government databases, identity verification providers, and hotel partners. DigiGo does not control these third parties and is not responsible for their actions.
4. Your Use of Services
You agree to use the Services only for lawful purposes and in accordance with these Terms.
You shall not:
- Upload false, misleading, fraudulent, or unauthorized information.
- Use the Services to impersonate another individual or entity.
- Interfere with the security, integrity, operation, or performance of the Services.
- Attempt to access accounts, data, or systems belonging to others without permission.
5. Data, Privacy & Consent
Your use of the Services is governed by the DigiGo Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains:
- What information DigiGo collects and how it is used.
- How identity verification and other personal data are processed.
- How and with whom your information may be shared, including hotel partners, service providers, and legal authorities.
By using the Services, you consent to the collection, use, disclosure, and processing of your information as described in the Privacy Policy.
6. Third-Party Services
- The Services may integrate with or include links to third-party services.
- DigiGo is not responsible for the availability, content, terms, or privacy practices of such third parties.
- Use of third-party services may be governed by separate terms between you and that provider.
7. Fees & Payments
- Certain features of the Services may require payment.
- You agree to pay all applicable fees as described at the time of purchase.
- Unless otherwise stated, all payments are non-refundable.
- DigiGo reserves the right to change pricing with notice.
8. Intellectual Property
- All intellectual property rights in the Services, including software, designs, trademarks, content, and data, are owned by DigiGo or its licensors.
- You are granted a limited, non-exclusive, non-transferable license to access and use the Services solely as permitted by these Terms.
- You may not copy, distribute, modify, reverse engineer, or exploit the Services beyond what is expressly permitted.
9. Suspension & Termination
- DigiGo may suspend or terminate your access to the Services for any reason, including suspected violations of these Terms.
- Upon termination, your right to use the Services will immediately cease, but obligations concerning privacy, intellectual property, and indemnity will survive.
10. Disclaimers & Warranties
The Services are provided on an "as is" and "as available" basis.
DigiGo does not guarantee that:
- The Services will be uninterrupted, secure, or error-free.
- Verification outcomes will meet your expectations.
DigiGo expressly disclaims all warranties, whether express, implied, or statutory.
11. Limitation of Liability
To the maximum extent permitted by law:
- DigiGo's total liability arising from or in connection with these Terms shall not exceed the amount you have paid to DigiGo in the past 1 month.
- DigiGo is not liable for indirect, incidental, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold DigiGo and its affiliates harmless from any claims, liabilities, losses, damages, and expenses arising from:
- Your breach of these Terms.
- Your misuse of the Services.
- Your violation of applicable laws or third-party rights.
13. Changes to Terms
We may update these Terms at our discretion. We will notify you of material changes — e.g., by posting a new version on the platform.
Your continued use of the Services after changes constitutes acceptance of the updated Terms.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of courts located in Mumbai, Maharashtra, India.
